VoteAmerica terms of service

Effective date: September 8, 2025

Welcome to VoteAmerica! These Terms of Service ("Terms") explain the rules and expectations for using our websites, applications, and digital tools (collectively, the "Services"). This includes any tools related to voter registration, voting reminders, and civic participation. This version applies to users 18 and older. If you are between 13 and 17 years of age and using FutureVoter, please view this terms of service.

By using our Services, you agree to these Terms and our Privacy Policy.

Acceptance of terms

By using our website or tools, you’re agreeing to follow these Terms of Service. Please read them carefully. If you don’t agree with any part of these terms, you shouldn’t use the site or any of our tools.

Changes to terms and conditions

This Agreement may change from time to time. The products and services provided through the Platform may also change. All changes are effective immediately upon being posted. Your continued use of the Platform after we make changes is deemed to be acceptance of those changes, so please check back periodically for updates.

Who we are

VoteAmerica is a nonpartisan, nonprofit organization working to increase voter turnout across the United States. Our tools help people register to vote, request absentee ballots, learn about voting deadlines, and more. 

When we say “VoteAmerica,” “we,” “us,” or “our,” we mean VoteAmerica and its affiliated entities: VoteAmerica Action Fund, VoteAmerica PAC, and VoteAmerica LLC.

When we say “you” or “user,” we mean anyone who visits or uses our websites, tools, apps, or services (collectively, the “Services”).

Who can use our services

Our Services are intended for U.S. citizens. You may use them if you:

  • Are at least 18 years old;

  • Have the legal authority to enter into these Terms;

  • Use the Services in compliance with these Terms and all applicable laws.

Your responsibilities

To use some of our Services, you may need to:

  • Provide your real name and accurate information;

  • Keep your information up to date;

  • Keep your login credentials (if applicable) secure.

You agree not to:

  • Pretend to be someone else;

  • Use our Services to break the law;

  • Interfere with or try to disrupt our systems or other users;

  • Post harmful, illegal, or misleading content.

Messaging and SMS terms

If you provide your phone number, we may send you election reminders or updates via text messages, prerecorded calls, or autodialed messages.

  • Message frequency will increase as elections approach.

  • Message and data rates may apply.

  • You can stop receiving texts by replying STOP. To get help, reply HELP.

We are not responsible for delayed or undelivered messages. For questions, email us at legal@voteamerica.org.

Communications

By using our Services, you agree that we may contact you via email, text message (SMS), phone call, or within the platform, depending on the information you provide and the choices you make.

You can opt out of emails or texts at any time. Just reply STOP to text messages or email us at privacy@voteamerica.org. Standard message and data rates may apply.

We do not share your SMS opt-in data or consent with any third parties.

Donations

If you donate to VoteAmerica, your contribution will go toward our mission of increasing voter participation across the U.S. Unless otherwise specified in a grant agreement, donations are unrestricted and used at our discretion.

Intellectual property

All content, tools, and branding on our Services are owned by VoteAmerica or our partners and are protected by intellectual property laws. You may use them for your own personal, non-commercial purposes but not copy, sell, or redistribute them without our permission.

If you post content through our Services, you keep ownership of that content but give us a license to use it to provide and promote our Services.

User content

You may be able to submit or post content (like messages, images, or comments) through our Services (“User Content”). By submitting content, you grant VoteAmerica a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute it as part of our civic engagement work.

You are responsible for the content you post and must not upload anything that is illegal, harmful, misleading, or violates someone else’s rights.

Use restrictions

You may not use our Services to:

  • Violate any law or regulation;

  • Share someone else’s private information without permission;

  • Interfere with or harm our systems or networks;

  • Attempt to access non-public areas of our Services;

  • Post spam, malware, or unauthorized advertisements.

Device requirements

You may only use the Platform on devices that you own or control and that are free of all potential malware. Devices that have been “jailbroken” may not be used. When remotely accessing the Platform, you must do so using a vetted, known wireless connection. If that is not available, the devices must exclusively use cellular networks. You may not access the Platform using unknown, unsecured wireless access points.

Third-party links

Our Services may contain links to third-party websites or tools. We’re not responsible for those sites or their content. Use them at your own risk and be sure to review their privacy policies and terms.

Disclaimer

We do our best to provide accurate and helpful information. However, we make no guarantees. Our Services are provided “as is” and “as available.” We do not guarantee that our Services will be error-free, uninterrupted, or secure.

Limitation of liability

To the fullest extent permitted by law, VoteAmerica is not responsible for any damages or losses that result from your use of our Services, including lost profits, lost data, or personal injury. Your only remedy if you are unhappy with our Services is to stop using them.

Indemnity

You agree to defend and hold harmless VoteAmerica and its team members from any legal claims, damages, or expenses arising from your use of our Services or your violation of these Terms.

Disputes and governing law

These Terms are governed by the laws of the State of California. You agree to resolve any disputes with VoteAmerica through arbitration in San Francisco, California, or in small claims court if eligible.

No assignment

You may not assign your rights or obligations under this Agreement without the prior express written consent of VoteAmerica.

Invalidity of provisions

In the event that any portion of this Agreement is held to be unenforceable, the unenforceable portion shall be construed in accordance with applicable law as nearly as possible to reflect the original intention and the remainder of the provisions shall remain in full force and effect.

No waiver

Any failure by VoteAmerica to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right.

Changes to these terms

We may update these Terms from time to time. If we make significant changes, we’ll let you know. The “Effective Date” at the top of this page will always show when the most recent changes were made. Your continued use of our Services means you accept the updated Terms.
